In OC Bail Bonds Can Secure Release For Those Arrested For Minor Crimes

Every year thousands of people are arrested for one reason or another. It would be wrong to think that it is only hardened criminals that fall foul of the law. Many ordinary people make mistakes. They drink and drive, they ignore a court order and sometimes they are just at the wrong place at the wrong time. Whatever the reason, being arrested is extremely stressful but luckily, for those living in OC bail bonds can ensure that they do not spend time in custody.

The justice system simply does not have the capacity to keep all arrested persons in custody until their cases can be heard. In most cases the prosecutor needs time to investigate the matter and to prepare the case. This may take some time and it is also a fact that some cases take a long time to go to trial. The majority of arrested people are therefore allowed to go free until the case against them is brought to court.

Not every accused qualified to go free until the case is heard. If the court is of the opinion that there is a string likelihood that the accused will flee from justice or that he will interfere with the investigation, then he may be remanded in custody. Before the accused can be released he has to pay a cash amount that must serve as guarantee that he will appear in court when required to do so.

A large percentage of arrested individuals simply do not have the cash to pay the amount required by the court. In such cases a bondsman can be approached. They provide instant loans to people that must pay bail. The accused will have to sign a contract and undertake to pay a fee that can be up to a tenth of the loan amount. Bondsmen are active near or at almost every court building.

Failing to heed the release conditions of the court can have dire consequences. Not only will the accused be arrested again but he will not qualify for bail a second time. In such cases the original deposit is forfeited and if the loan amount cannot be paid back to the bondsman the accused may see his assets confiscated and sold to honor his debt.

Critics argue that it is irresponsible to allow accused to go free. They say that this practice simply allow those who were released to commit even more crime. The facts are that there are not enough holding facilities to keep all accused people incarcerated. Most accused pose no threat to anybody. They need to earn and to help their families to survive.

It must also be kept in mind that a large percentage of cases are thrown out of court because of lack of evidence and it is not fair to detain the accused indefinitely. Many others are found to be innocent or they are convicted of minor offences that simply do not justify detention. Innocence is presumed and there are excellent reasons for this approach.

The first priority of any person that was arrested is to arrange bail. This can only be achieved if the amount set by the court can be met in hard cash. Bondsmen provide a valuable service in this respect and even though they charge high fees, most accused will happily pay them if only they can return to their loved ones.
